A legacy is a gift of money, property or possessions left in your will. Legacies of all sizes are invaluable. Charities are exempt from Inheritance Tax, so leaving money to Mind in Brighton and Hove means that the charity benefits from every penny.
There are three different types of legacies:
A gift of the whole or a share of whatever remains of your estate after all other gifts have been distributed and any debts paid off.
Suggested wording for a residuary legacy:
"I give ____________________* of the residue of my estate absolutely to Mind in Brighton and Hove of 79 Buckingham Road, Brighton, BN1 3RJ, Registered Charity Number 1071434, for its general purposes. I direct that the receipt of the Administrator or other duly authorised officer shall be a sufficient discharge to my executors."
* State all or the percentage/fraction of the residue of your estate that you wish to leave.
A gift of a fixed sum of money. You can protect this type of gift from inflation by linking it to the Retail Price Index.
Suggested wording for a pecuniary legacy:
"I give the following legacy free of tax to Mind in Brighton and Hove of 79 Buckingham Road, Brighton, BN1 3RJ, Registered Charity Number 1071434, the sum of ____________________ (amount in figures and words) for its general charitable purposes. I direct that the receipt of the Administrator or other duly authorised officer shall be a sufficient discharge to my executors."
A tangible item such as a house, piece of jewellery, silver teapot or car.
Suggested wording for a special gift:
"I give to Mind in Brighton and Hove of 79 Buckingham Road, Brighton, BN1 3RJ, Registered Charity Number 1071434, my ____________________* for its general charitable purposes. I direct that the receipt of the Administrator or other duly authorised officer shall be a sufficient discharge to my executors."
* Add a description of whatever you wish to leave. "
If you have already made your will, you can still leave a gift to Mind in Brighton and Hove. By adding a codicil to your will, you can leave a legacy to Mind in Brighton and Hove whilst ensuring that the other provisions in your will remain untouched, and you won't have to pay for your will to be completely re-written. Again you need to give instructions to your Solicitor.
Suggested wording for a Codicil:
"This is a Codicil of me ____________________ (name) of ____________________ (address) to my Will dated (date). I give ____________________ (amount in figures and words) to Mind in Brighton and Hove of 79 Buckingham Road, Brighton, BN1 3RJ, Registered Charity Number 1071434, for its general charitable purposes. I direct that the receipt of the Administrator or other duly authorised officer shall be a sufficient discharge to my executors. In all other respects I confirm my Will dated ____________________ (date of original Will)."
